Why Was My Claim Denied?
There can be several reasons for a claim denial. However, the most common reasons include not following your employer’s reporting process and not seeking medical care immediately following the incident.
Typically, large employers have very specific rules that outline their workers’ compensation process, and injured employees are expected to comply.
In some cases, voluntary abandonment of employment bars an injured worker from receiving compensation. This generally occurs if the employee violates a work rule, resulting in termination.
What Can I Do Now That My Claim Has Been Denied?
After a denial by the BWC, you will have 14 days to file an appeal. You must file an appeal if your claim is denied. Filing that appeal will trigger a hearing to be scheduled at the Ohio Industrial Commission. A hearing officer will listen to your case and review all the evidence and information provided, and render a decision. What you present at that hearing by way of medical evidence and testimony will determine the outcome of your claim.
You owe it to yourself to present the best case to the Industrial Commission hearing officers. While hearings are not trials they are a formal process where it is crucial that you have an attorney to represent your interests.
